How adjustment of status works for Bangladeshi applicants
Adjustment of status is the process by which a person already in the United States applies to become a lawful permanent resident without leaving for an immigrant visa interview abroad. For Bangladeshi nationals it is often used by spouses of US citizens, H-1B and L-1 workers with employer-sponsored petitions, and others whose category becomes current while they are in the country. TRW & Co is a Bangladesh firm: we prepare and coordinate these matters with US-licensed immigration counsel, and we do not ourselves represent clients before USCIS or US consulates. Our private client lawyers in Bangladesh handle the Bangladeshi side.
The core filing is the application to register permanent residence, usually filed with or after an approved family or employment petition, together with supporting evidence such as civil documents, the medical examination record and financial sponsorship where required. Many applicants also file for an employment authorisation document and for advance parole at the same time. Since the April 2024 USCIS fee rule, those ancillary applications carry their own fees rather than being included, and further charges followed US legislation in 2025. Our insight article on US immigration forms and fees sets out the current framework.
In May 2026 USCIS issued policy guidance describing adjustment of status as a matter of discretion and presenting consular processing abroad as the standard route to permanent residence. The guidance applies to pending and new cases. Officers are told to weigh factors such as past status violations, failure to depart as expected and misrepresentation, and those who travelled on advance parole without a dual-intent status face closer scrutiny. Statutory eligibility has not changed, and applicants in dual-intent categories such as H-1B and L-1 are less directly affected, but each case now needs a careful assessment of risk.
Work and travel are where many applicants go wrong. Someone without an existing work status generally may not work until a work permit is issued, and EADs granted to adjustment applicants have since December 2025 been limited to a maximum of eighteen months. Automatic extensions were ended for many categories in October 2025, so renewals must be filed early. Leaving the United States without advance parole is usually treated as abandoning the application, unless the applicant maintains H-1B or L-1 status and returns on a valid visa. These rules matter greatly to families with ties in Bangladesh.
Many of our clients have parents, property and businesses in Bangladesh. A medical emergency, a death in the family or a land dispute can create pressure to travel while a case is pending. We help clients understand the risks with US counsel before booking a flight, prepare Bangladeshi evidence for emergency travel requests during adjustment of status, and use powers of attorney so that property, inheritance and court matters at home can proceed without a trip. Where a dispute in Bangladesh needs action, our dispute resolution lawyers can act locally while the applicant stays put.

Eligibility and risk assessment
With US-licensed counsel, we review the applicant's entry, status history, any overstays or unauthorised work, the underlying petition and earlier visa applications made in Dhaka. We then assess whether adjustment of status or consular processing is the safer route in light of the 2026 discretion guidance, and explain the risks in plain terms before any filing, so the family can make an informed decision. Our joint advice is confirmed in writing.
Bangladeshi civil documents
We obtain and check birth registration, nikah and divorce registration entries, court records and name-change evidence from Bangladesh, arrange certified translations, and resolve inconsistencies between passports, NID cards and educational certificates. Accurate civil documents are essential to adjustment of status, because discrepancies invite requests for evidence, delay interviews and can raise questions about identity or about whether an earlier marriage ended lawfully. We also explain any genuine gaps openly in a covering note.
Work permit planning
We help applicants and employers plan employment authorisation during adjustment of status: who may keep working on an existing status, who must wait for an EAD, how the shorter validity periods affect renewals and when to file them. We coordinate with US counsel so that no gap in work authorisation arises, and we advise Bangladeshi family businesses on whether a relative abroad may lawfully work for them remotely. Clear records help employers reverify on time and avoid disruption.
Advance parole and travel
Before any trip outside the United States, we work with US counsel to confirm whether the applicant needs advance parole, whether unlawful presence or other issues make travel risky, and how the 2026 guidance treats parole travellers. For emergencies in Bangladesh, we gather medical reports, death certificates and other evidence quickly to support an expedited or emergency advance parole request at a USCIS office. Planning ahead avoids rushed and costly decisions.
Interview and evidence requests
During adjustment of status, USCIS may issue a request for evidence or call the applicant for an interview, particularly in marriage-based cases. We help prepare clear responses using Bangladeshi records, relationship evidence and affidavits, and prepare applicants and spouses for interview questions. Where an earlier refusal or a discrepancy in a Dhaka visa application exists, we help US counsel explain it consistently and truthfully. Good preparation reduces both anxiety and errors.
Affairs at home during the case
While a green card application is pending, we look after the client's interests in Bangladesh: powers of attorney, property management, inheritance and mutation, family court matters and company records. We also advise on Bangladeshi dual nationality, tax residence and remittances for those who will become US residents, so the move does not leave legal loose ends at home or unexpected tax consequences. We remain the client's trusted point of contact at home throughout.

Meet the firm →01Who can apply for adjustment of status instead of a Dhaka interview?
In general, a person who was inspected and admitted or paroled into the United States, who has an approved or concurrently filed qualifying petition, and whose immigrant visa category is available. Immediate relatives of US citizens can often adjust even after overstaying a visa, while most other applicants must have maintained lawful status. Entry without inspection, certain status violations and some criminal or immigration history can bar adjustment of status entirely. Because the May 2026 guidance treats approval as discretionary, eligibility alone is no longer the end of the analysis, and US counsel must weigh the whole history.
02Can I work while my green card application is pending?
Only if you have authorisation. If you already hold a work status such as H-1B or L-1, you can usually continue working for the sponsoring employer under that status. Otherwise you must apply for an employment authorisation document and wait until it is approved before starting work, including unpaid work for a family business. Unauthorised employment can damage the application, particularly under the 2026 discretion guidance. EADs issued on the basis of a pending adjustment of status now have shorter validity, so renewals need to be diarised and filed in good time.
03Can I travel to Bangladesh while my case is pending?
Not safely without planning. If you leave the United States without advance parole, the application is normally treated as abandoned, unless you hold H-1B or L-1 status, or a dependant status, and return on a valid visa in that category. Even with advance parole, re-entry is not guaranteed, and the 2026 guidance indicates closer scrutiny of applicants who travel on parole without a dual-intent status. Past unlawful presence or an earlier overstay can also create complications. Before booking any trip, speak to us and US counsel about your particular adjustment of status history.
04What is advance parole and how long does it take?
Advance parole is a travel document that allows an applicant with a pending green card case to seek re-entry to the United States after travelling abroad. It is applied for on a separate form, usually filed with the main application, and processing times can run to many months. In genuine emergencies, such as a parent's serious illness or a death in the family in Bangladesh, an applicant can ask USCIS for expedited processing or emergency advance parole at a local office, supported by documents. We help gather that adjustment of status evidence from Bangladesh quickly and accurately.
05My parent in Bangladesh is seriously ill. What should I do?
First, do not book travel before checking your position. Contact US counsel and us immediately with your status, pending applications and any prior immigration issues. If travel is advisable, we obtain hospital reports, doctor's letters and proof of relationship from Bangladesh, translated and certified, to support an emergency advance parole request. If travel is too risky for your adjustment of status, we can act for you in Bangladesh: speaking with hospitals, handling powers of attorney, and dealing with inheritance or property matters if the worst happens, so that urgent family needs are met.
06How has the May 2026 USCIS guidance changed things?
The guidance describes adjustment of status as discretionary relief and treats consular processing abroad as the ordinary route. It does not change who is legally eligible or add new forms, but it instructs officers to weigh negative factors such as status violations, failure to depart and misrepresentation more heavily, and it applies to pending cases. Outcomes under it are still emerging and legal challenges are possible. For each client, we work with US counsel to assess whether to proceed, withdraw and process through the US Embassy in Dhaka, or strengthen the evidence of positive factors.
07Do I need documents from Bangladesh for adjustment of status?
Almost always. Applicants generally need a passport, a birth certificate or acceptable substitute, marriage registration where relevant, proof that any earlier marriage ended, and court records for any arrests or convictions, plus certified English translations. Bangladeshi birth registrations that were made late, or that spell names differently from passports, often draw questions. We obtain certified copies, check registration entries with the issuing authority, prepare explanatory affidavits and arrange translations. Organised, consistent documents help USCIS process the case without unnecessary requests for evidence. Starting this work early usually prevents delay at the interview stage.
08Should I choose adjustment of status or consular processing in Dhaka?
It depends on the facts. Adjustment of status lets the applicant stay in the United States, work and travel with the right documents, and avoid a trip abroad. Consular processing involves an immigrant visa interview at the US Embassy in Dhaka and travel to the United States afterwards. After the May 2026 guidance, consular processing may be preferable for applicants with weaker discretionary profiles, but leaving the United States can trigger bars for people with unlawful presence. US counsel advise on the US-law position, and we prepare the Bangladeshi side for either route.
From first call to resolution.

Throughout adjustment of status, we track work permit validity, plan any travel with US counsel, respond quickly and fully to requests for evidence and keep property, family and court matters in Bangladesh moving through powers of attorney.
- 04
Interview and after
We prepare the applicant for any USCIS interview and, after approval, advise on conditional residence, US tax status, Bangladeshi dual nationality, remittances and estate planning across both countries. We stay involved after approval where clients wish.
