Domain Name Portfolio, DNS Governance and UDRP Coordination in Bangladesh

We help Bangladeshi brands and foreign businesses active in Bangladesh protect and manage their domain name portfolio: .bd and generic registrations, DNS and registrar control, cybersquatting and phishing responses, UDRP complaints, transfers in transactions, and the trade mark rights that make recovery possible.

Overview

Domain name protection and DNS governance for Bangladeshi brands

A company's domain name is now one of its most valuable business assets. It carries the website customers trust, the email addresses staff use every day, the payment pages of e-commerce platforms and the login screens of banking and mobile financial services. In Bangladesh, where digital commerce and mobile banking have grown rapidly, lookalike domains are a common tool for fraud and phishing. We help clients treat domains as legal assets with owners, records and controls, as part of our technology, IP and data practice in Bangladesh, alongside their trade mark and cyber security work.

Many Bangladeshi businesses discover problems only when something goes wrong. A domain name was registered years ago by a former employee, a web developer or an agency in its own name. Renewal notices go to an inbox nobody checks. A family business splits and two branches claim the same address. A foreign parent and its Bangladeshi subsidiary each believe they control the .com.bd registration. These situations are avoidable with clear ownership records, registrar accounts held by the company, two-factor authentication and a documented process for renewals, changes to DNS settings and access by outside service providers.

The legal framework depends on the extension. Generic top-level domains such as .com, .net and the newer gTLDs are subject to the Uniform Domain Name Dispute Resolution Policy (UDRP), administered by ICANN-approved providers such as the WIPO Arbitration and Mediation Center. Country code domains such as .bd and .বাংলা are administered by the national registry operated through Bangladesh Telecommunications Company Limited (BTCL) under its own terms rather than the UDRP. Disputes over .bd names may therefore require engagement with the registry, reliance on registration terms or, where necessary, proceedings in the Bangladeshi courts. Choosing the forum comes first.

Trade mark rights are the foundation of most domain name recovery. A UDRP complainant must show rights in a trade mark, that the disputed name is identical or confusingly similar, that the registrant has no legitimate interest and that the name was registered and is being used in bad faith. Registered marks under the Trademarks Act 2009, administered by the Department of Patents, Designs and Trademarks (DPDT), make that first element straightforward, and passing off and infringement claims remain available in court. Brands planning a launch should align trade mark filings and domain registrations from the start.

Our work covers the whole lifecycle: auditing and consolidating portfolios, setting governance policies, monitoring for infringing registrations, sending cease and desist letters, preparing UDRP complaints, coordinating with registrars, hosting providers and payment platforms on takedowns, and handling domains in mergers, acquisitions and group reorganisations. We work with counsel abroad when a registrant or provider is overseas, and with technical teams on DNS security. If a lookalike site is targeting your customers today, contact our Dhaka office so that evidence can be preserved quickly. Early action often decides whether a domain name can be recovered at all, and protects customers.

01

Portfolio audit and consolidation

We identify every domain name the group uses or should own, check who is recorded as registrant, which registrar holds each one, when renewals fall due and who controls the DNS settings. We then plan the consolidation of registrations into company-controlled accounts, recover names held by former staff or agencies, and decide which defensive registrations are worth keeping and which can lapse. The result is a clear register that management can rely on.

02

DNS and registrar governance

We draft internal policies and contract terms that set out who may change DNS records, transfer domains or create subdomains, how access is granted to agencies and cloud providers, and how renewals and registrar locks are managed. We align these with information security policies and outsourcing contracts so that a single compromised account cannot redirect the company's website or email traffic. We also set rules for emergency changes and approvals.

03

UDRP and URS complaints

We assess whether a disputed generic domain is a strong candidate for a UDRP complaint, gather evidence of the client's trade mark rights and the registrant's bad faith, and prepare and file complaints with WIPO or another approved provider. For clear cases involving new gTLDs, we consider the faster Uniform Rapid Suspension procedure as an alternative to full transfer proceedings. We draft submissions that are concise and well evidenced.

04

.bd registry and court action

For .bd and .com.bd names we review the registration history, the registry's terms and the documents the applicant relied on, and engage with the registry where an error or misuse can be shown. Where a negotiated or administrative route fails, we advise on civil proceedings for passing off, trade mark infringement or declarations of ownership in the Bangladeshi courts, including interim relief. Each step is planned with costs and timing explained.

05

Phishing and impersonation response

When lookalike domains are used for fraud, fake job offers or phishing against customers, we act quickly to preserve evidence, send notices to registrars, hosting providers and payment platforms, and coordinate with banks and law enforcement where appropriate. We also advise on customer communications and on any data protection obligations triggered if personal data has been captured by the fraudulent site. Speed is usually the deciding factor.

06

Domains in transactions

Domains are often forgotten in acquisitions, asset sales, joint ventures and group restructurings. We include them in due diligence, draft asset transfer schedules and transition arrangements, and manage registrar transfers so that websites and email continue to work on completion. For brand licences and franchises we set rules on whether licensees may register domains containing the licensed mark. Each domain name is then verified after completion.

Someone has registered a domain name using our brand. Can we get it back, and how long might that take?

Often, yes. For generic extensions such as .com, the UDRP allows a trade mark owner to seek transfer if the domain name is confusingly similar to its mark, the registrant has no legitimate interest and the name was registered and used in bad faith. Proceedings are conducted on written submissions and a decision is commonly issued within about two months of filing. For .bd names, the route depends on the registry's terms and may involve court action. We first check the evidence, the registrant's activity and whether a negotiated transfer is cheaper and quicker. Speed matters, so early instruction helps.

02

Does the UDRP apply to .bd and .com.bd domains?

No. The UDRP applies to generic top-level domains and to those country code domains whose registries have chosen to adopt it. The .bd domain is administered nationally through BTCL under its own registration terms, and we are not aware that the UDRP has been adopted for it. Disputes over .bd domain name registrations therefore usually involve reviewing how the name was registered, raising the matter with the registry where documents were misused or rules were breached, and, if needed, seeking remedies for passing off or trade mark infringement in the Bangladeshi courts. Prompt action strengthens the position considerably.

03

Do we need a registered trade mark in Bangladesh to win a domain name dispute?

A registered mark is the strongest foundation, but it is not always essential. Under the UDRP, panels can recognise unregistered rights where the complainant shows that its name has acquired distinctiveness through use, though that requires more evidence. Registration under the Trademarks Act 2009 with DPDT, or in other relevant countries, makes the first element of a complaint simple to prove. In court, passing off can protect goodwill without registration. We usually recommend filing trade mark applications for key brands early, before launching websites or apps that might attract cybersquatters. This strengthens any later domain name complaint considerably.

04

Our web agency registered our domain name in its own name. What can we do?

This is common. First, check the contract with the agency for ownership and transfer clauses, and gather evidence that the domain was registered for your business and paid for by you. Many agencies cooperate once asked formally. If they refuse or have closed, we can send a legal notice demanding transfer, approach the registrar with supporting documents and, for generic domains, consider a UDRP complaint if bad faith can be shown. For the future, we draft agency contracts that require registration in the client's name from the start. Keeping invoices and correspondence helps greatly. Agencies usually respond to formal requests.

05

How should a group with many brands organise its domain name portfolio?

Good practice is to hold all registrations through a small number of registrar accounts controlled by the company, not individuals, with role-based access, two-factor authentication and registrar locks on key names. A central register should record each domain, its purpose, the related trade mark, renewal dates, DNS hosting and the responsible person. Defensive registrations should be reviewed regularly against cost and actual risk. We help groups write a portfolio policy, assign ownership within the business and align domain strategy with trade mark filings in Bangladesh and export markets. Ownership records should be checked annually.

06

What evidence should we collect when a fake website is targeting our customers?

Act fast, because fraudulent sites often disappear and reappear under new names. Capture dated screenshots of every page, copy the full URLs, save page source where possible, and record any emails, SMS messages or social media posts that direct customers to the site. Run a lookup of registration and hosting details. Keep records of complaints from customers and any financial loss. This evidence supports takedown requests, a UDRP complaint, a police complaint and any later civil action. We can coordinate the evidence process and the notices to registrars and hosts. Do not engage directly with the fraudsters.

07

Can a domain name be transferred as part of selling a business in Bangladesh?

Yes. Domains are transferable assets, but the process depends on the registrar or registry, and .bd registrations may require documentation showing the new holder's entitlement. In a share sale, the registrant company stays the same, though control of the registrar account still needs to pass to the buyer's management. In an asset sale or reorganisation, the domain name should be listed in the transfer documents and the registrar change planned, so that the website and email are not interrupted. We include domains, DNS and hosting in transaction due diligence and completion checklists. Missing steps can cause costly outages.

08

Is cybersquatting a criminal offence in Bangladesh?

Bangladesh does not have a statute that makes cybersquatting, as such, a specific criminal offence. Registering a domain name that copies a brand is usually addressed through civil remedies, trade mark law and dispute policies such as the UDRP. However, where a lookalike domain is used for fraud, impersonation or phishing, the conduct may fall within offences under the Penal Code and Bangladesh's cyber security legislation, and a complaint to law enforcement may be appropriate. We advise on whether a criminal complaint, civil proceedings or an administrative complaint offers the most effective route. Evidence quality is critical in every route.

How a matter runs

From first call to resolution.

  1. 01

    Initial assessment

We review the domains, trade marks, contracts and evidence involved, identify the urgent risks such as active phishing or expiring registrations, and recommend the quickest effective route for recovery, protection or reorganisation. We explain costs and likely timing at the outset.

  2. 02

    Evidence and notices

We preserve evidence, confirm registrant and hosting details, and send formal notices to registrants, registrars, hosts or agencies, often resolving matters by negotiated transfer before any formal domain name proceedings are needed. Notices are firm, factual and carefully worded.

  3. 03

    Formal proceedings

Where negotiation fails, we prepare and file UDRP or URS complaints, engage the .bd registry, or bring court proceedings in Bangladesh, coordinating with counsel abroad where the registrant or provider is overseas. We keep clients updated at every stage of the case.

  4. 04

    Portfolio governance

After the immediate issue, we help consolidate registrations, set registrar and DNS policies, organise monitoring and align future domain registrations with trade mark filings so that the same problem does not recur. Monitoring then gives early warning of new registrations.

“Demonstrates an extraordinary command over both domestic litigation and international arbitration.”

FAQ

Questions, answered.

Still unsure? Email info@trw.co with a short outline of the matter.

What is a domain name dispute?
A domain name dispute arises when someone registers or uses a domain that conflicts with another person's rights, usually a trade mark or business name. Typical cases involve cybersquatting, where a name is registered to sell it back to the brand owner, lookalike domains used for fraud, and disagreements between former business partners, agencies or employees about who owns a registration. Some disputes also arise within families or between group companies. Each needs a different approach.
What is the UDRP?
The Uniform Domain Name Dispute Resolution Policy is a policy adopted by ICANN that applies to generic top-level domains. It allows a trade mark owner to file a complaint with an approved provider, such as the WIPO Arbitration and Mediation Center, seeking transfer or cancellation of an abusive registration. It is faster and cheaper than court action, but the only remedies are transfer or cancellation. It does not award damages or costs, so its scope is deliberately narrow and focused.
Who manages .bd domain registrations?
The .bd country code top-level domain and its Bangla script equivalent are administered nationally through Bangladesh Telecommunications Company Limited, with registrations offered under second-level categories such as .com.bd and .org.bd. Applicants generally need to provide documentation supporting their entitlement, and the registry's own terms govern registration, renewal and transfer. We help clients with complex or disputed .bd registrations. Accurate documents at the application stage prevent most later domain name problems. Renewal dates also need tracking.
Can a UDRP decision be challenged?
A UDRP decision is implemented by the registrar after a short waiting period unless the losing registrant starts court proceedings in an appropriate jurisdiction within that time. The UDRP does not prevent either party from going to court. In practice most decisions are implemented. We advise on the risk of a court challenge when deciding where and how to file a domain name complaint. Choosing the mutual jurisdiction in the complaint deserves some thought. Keep the complaint, response and decision on file, as they will be needed quickly if a court challenge follows.
How much does it cost to recover a domain name?
Costs vary with the route. A negotiated transfer may involve only legal fees for notices and documents. A UDRP complaint involves the provider's filing fee, which depends on the number of domains and panellists, plus legal fees for preparing the complaint. Court proceedings in Bangladesh are usually more expensive and slower. We give a fee estimate once we have assessed the case. The cost of losing customers to a fraudulent domain name is usually far higher.
Should we register our brand in every domain extension?
No. Registering every extension is costly and rarely necessary. Most businesses should hold their brand in the main generic extensions, .bd and the extensions of key export markets, plus common misspellings where fraud risk is high. Monitoring services and trade mark registrations often provide better value than large defensive portfolios. We help clients set a proportionate registration policy based on their markets and risks. Policies should be reviewed as the business grows. Lapsed names can be re-registered by others.
What is DNS governance and why does it matter legally?
DNS governance means controlling who can change the records that direct your domain to websites, email servers and other services. If an attacker or a departing contractor changes those records, they can redirect traffic, intercept email or take a business offline. Clear policies, access controls and contract terms reduce that risk and help show that the company took reasonable security measures. It also supports compliance with data protection duties. Registrar locks add a further layer.
How can TRW help with an urgent domain name problem?
Send us the domain, a short description of the problem and any evidence you already have. We will run a conflict check and advise on immediate steps, such as preserving evidence and sending takedown notices, usually within a short time. We then recommend whether negotiation, a UDRP complaint, registry engagement or court action is the most effective route for your situation. Fast action often limits harm to customers and to the brand. We can work across time zones.
