Environmental-clearance questions in Bangladesh begin with the Bangladesh Environment Conservation Act, 1995, the Environment Conservation Rules, 2023, and Department of Environment (DoE) materials. The official records cited below identify the statutory provision, the Gazette entry for the Rules, and the regulator pages that make related documents and online resources publicly available. They matter because they establish the primary legal and regulatory record from which an environmental-clearance question begins. They do not, by themselves, determine the classification of a particular industrial establishment, project, building or other matter, or the result on a particular set of facts. The distinction between statutory text, Rules, public forms and online links remains material when reading the record.
The legal record
The statutory starting point
The official Bangladesh Laws record for the Bangladesh Environment Conservation Act, 1995 includes section 12, headed “environmental clearance”. Section 12 addresses environmental clearance in relation to industrial establishments and projects, including expansion, and refers to the prescribed manner. The provision also identifies matters that may be addressed in Rules on environmental clearance. [1]
The official online Act record incorporates amendment-linked text but does not display a clear consolidated-text currency date. Without that date, the record does not support a complete determination of the current legal position.
The 2023 Rules in official records
The Department of Printing and Publications’ official Extraordinary Gazette entry identifies the Environment Conservation Rules, 2023 as S.R.O. No. 53-Law/2023, dated 5 March 2023, under the Ministry of Environment and Forest, at Gazette pages 3009–3115. [2]
The Ministry of Environment, Forest and Climate Change’s environmental-law page publicly links both the 1995 Act and the 2023 Rules. That page displayed a content-update date of 17 September 2026 when accessed. [3] The two pages provide dated official source records; they do not offer a rule-by-rule interpretation or confirm how every factual situation is treated.
Official DoE source locations
The Department of Environment (DoE) maintains a page headed Environment Conservation Rules, 2023, which links the Rules and a number of clearance-related materials. The page displayed a content-update date of 9 April 2023. [4] Separately, the DoE’s public forms index contains 2023-Rules-labelled materials concerning industrial establishments, buildings, clinics, renewals and a red-category declaration. [5]
The DoE also maintains a page headed Online clearance application. Its public links include an online application location, a page described as required documents, and a user manual; the page displayed a content-update date of 30 November 2024. [6] Those links identify publicly available material but do not establish that a particular item applies, is complete, is current for a particular matter, or will lead to a specified result.
The live DoE Rules page and the DoE forms index use non-matching labels for the environmental-clearance renewal material. For that reason, no form number is identified here, and a public listing is not recast as a filing instruction.
Reading the record in context
A statutory heading, a Gazette entry, a forms index and a linked online resource answer different questions. None of those items, by itself, classifies a particular activity, location, project, change or existing record. Nor do they establish a universal sequence, an available channel, eligibility, a complete document package, acceptance of a submission, or the issue, renewal, amendment, suspension or refusal of a certificate.
The rechecked sources are not used here to state fees, taxes, payment arrangements, processing periods, service standards, validity, expiry, renewal deadlines, conditions, monitoring expectations, inspections, enforcement, penalties or appeals. Those propositions require a different, current and fact-specific legal analysis. Questions involving technical studies, design, sampling, laboratory work, process controls or environmental evidence likewise fall outside the material identified above.
Source and date note
All materials cited below are official Bangladesh Government or regulator sources and were accessed on 21 September 2026. The access date records what was publicly available on that date; it does not establish that the material is exhaustive, consolidated, operative for every factual setting or determinative of an individual result.
The Act (1995) and Rules (2023) are identified above as dated instruments. No historical material is used to state a present procedure, fee, classification, entitlement, deadline or outcome.
