How we support EB-3 visa cases from Bangladesh
The EB-3 visa is the third-preference US employment-based green card. It covers skilled workers with at least two years of training or experience, professionals whose job requires a US bachelor's degree or foreign equivalent, and other workers in roles needing less than two years of training. Unlike EB-1A or the national interest waiver, it depends on a genuine permanent job offer from a US employer, usually supported by labour certification from the Department of Labor. For Bangladeshi nurses, engineers, technicians, accountants and hospitality staff, it can be a realistic route when the employer and the paperwork are sound.
TRW is a Bangladesh law firm, with a defined role. We verify the job offer and employer, review any recruitment or agency arrangements, document the worker's Bangladeshi qualifications and experience, and handle Bangladesh law questions such as tax, property and foreign exchange. We prepare and coordinate every matter with US-licensed immigration counsel, who act for the petitioning employer or the worker as appropriate, file with US agencies and represent clients. TRW does not itself represent clients before USCIS, the Department of Labor or US consulates. The work sits within our private client practice, with employment lawyers involved where needed.
Most EB-3 visa cases run in three stages. First, the employer obtains a prevailing wage determination, carries out required recruitment to test the US labour market and files for labour certification. Second, once certification is approved, the employer files a Form I-140 petition with USCIS showing the job, the worker's qualifications and its ability to pay the offered wage. Third, when the priority date is current in the Visa Bulletin, the worker completes the green card stage, usually through the National Visa Center and an interview at the US Embassy in Dhaka. Each stage depends on accurate evidence from Bangladesh.
Fraud is a real risk in the EB-3 visa field. Bangladeshi workers are regularly offered EB-3 visa jobs, particularly in the other workers subcategory, by agents demanding large payments. US rules generally require the employer to bear the costs of labour certification, and a genuine sponsor does not need a worker to pay for a job offer. We check the employer's existence and standing, the offer letter, the wage, any agency contract and who is paying for what. Where an arrangement looks unsafe, we say so plainly before the worker pays any money or resigns from employment in Bangladesh.
The 2026 position needs checking case by case. The worldwide EB-3 queue, which includes Bangladesh, has involved waiting times, and the other workers line is often longer. A 100,000 USD payment imposed on certain new H-1B petitions by a September 2025 proclamation, since extended and contested in the US courts, has led some employers to consider direct green card sponsorship. Immigrant visa interviews in Dhaka were also disrupted in 2026 by successive processing pauses. We review the current Visa Bulletin and consular position before advising on any EB-3 visa timeline, and our Dhaka office can arrange an assessment.

Job offer and employer verification
Before a worker commits, we check that the US employer exists, is trading, and has the capacity to pay the offered wage, and we review the offer letter, job description and any recruitment or agency agreement. Our aim is to separate genuine EB-3 visa opportunities from schemes that charge workers for jobs, and to document the findings in a short written report for the client.
Qualification and experience evidence
Labour certification and the I-140 petition both rely on proof that the worker met the job's requirements before being hired. We gather Bangladeshi degree certificates, transcripts, professional registrations and detailed experience letters stating duties, dates and hours, coordinate credential evaluations accepted in US practice and resolve inconsistencies in names, dates and job titles across documents, so the EB-3 visa petition stands on verified evidence.
Support for US employers
US companies hiring Bangladeshi staff need reliable foreign evidence quickly. We work with the employer's US immigration counsel to obtain and verify the worker's records, explain Bangladeshi qualifications and professional bodies, and prepare documents for the consular stage. Where a Bangladeshi group is placing staff with a US affiliate, we also advise on the corporate and employment arrangements in Bangladesh, and on related foreign exchange matters.
Nurses and healthcare workers
Registered nurses are among the occupations for which US rules allow a simplified route to labour certification. Bangladeshi nurses still need verified nursing qualifications, registration records, English test results where relevant and steps toward US licensing. We organise these documents, check the employer's offer and coordinate with US counsel on the order in which licensing, petition filing and the visa stage should proceed for each worker.
Consular processing in Dhaka
When the priority date becomes current, we prepare the worker's civil documents for the National Visa Center: birth and marriage records, police clearance certificates, passports and certified translations. We check every document against earlier forms and visa applications, explain the medical examination and interview process, and brief the worker and family members before the immigrant visa interview at the US Embassy in Dhaka, alongside US counsel.
Bangladesh tax and relocation
Leaving Bangladesh on an EB-3 visa for permanent US employment has local consequences. We advise on tax residency and final returns, wealth statements, provident fund and gratuity entitlements from the current employer, notice periods, property and bank accounts left behind, and powers of attorney. For families relocating in stages, we plan guardianship, schooling and the timing of each member's EB-3 visa application with US counsel.

Meet the firm →01Can I apply for an EB-3 visa myself without a US employer?
No. The EB-3 visa is employer-sponsored. A US employer must offer a permanent, full-time job and, in most cases, complete labour certification before filing the I-140 petition for the worker. Workers cannot self-petition in this category, which is a key difference from EB-1A and the national interest waiver. What a worker can do is make sure any offer is genuine, that their qualifications match the job requirements and that their documents are in order. We help with all three, and coordinate with the employer's US counsel once the process begins. Early checks avoid wasted years and money.
02Which EB-3 visa subcategory fits my qualifications and the job?
It depends on the job offered, not just on the worker's own background. The professionals subcategory needs a job requiring a US bachelor's degree or foreign equivalent, which the worker must hold. The skilled workers subcategory covers roles requiring at least two years of training or experience. The other workers subcategory covers roles requiring less than two years. The labour certification sets out the requirements, and the worker must have met them before joining the employer. We review the offer, the job description and the worker's Bangladeshi records together to confirm the right subcategory with US counsel.
03An agent wants a large fee for an EB-3 visa job. Is that normal?
It is a serious warning sign. US rules generally prohibit passing the costs of labour certification, including recruitment and attorney fees for that stage, on to the worker, and genuine employers do not sell job offers. Some agents in Bangladesh promise jobs in the US in return for large advance payments, then disappear with the money or deliver offers that cannot be certified. Before paying anything, ask us to check the employer, the offer and the contract. We give a short written view, and where there are signs of fraud we advise on reporting and recovery options in Bangladesh.
04How long does an EB-3 visa case take from Bangladesh?
Usually longer than applicants and employers expect. The prevailing wage, recruitment and labour certification stages can take many months, and Department of Labor processing times vary. The I-140 petition follows and can be accelerated with premium processing. The worker must then wait until their priority date, normally the date the labour certification was filed, is current for the worldwide EB-3 category, and the other workers line is often slower. Consular processing in Dhaka then follows, and 2026 has seen interview disruption. We give a staged estimate for each EB-3 visa stage and update it as conditions change.
05Can I bring my spouse and children on an EB-3 visa?
Yes. A spouse and unmarried children under 21 can generally receive green cards as derivatives of the principal worker, without needing their own separate petitions. They must be included properly at the visa stage, with consistent Bangladeshi marriage and birth records, police certificates where required and certified translations. Because EB-3 waits can be long, children nearing 21 need early attention, and US rules on age calculation should be reviewed with US counsel. We also help families decide sensibly whether to travel together or in stages and what practical arrangements to put in place in Bangladesh.
06What does TRW do, and what does US immigration counsel do on an EB-3 visa case?
TRW is a Bangladesh law firm. We verify employers and offers, review agency contracts, gather and verify Bangladeshi qualifications and experience records, prepare consular documents and advise on Bangladesh tax, employment and foreign exchange matters. US-licensed immigration counsel handle labour certification and petition filings under US law, usually acting for the employer, and represent clients before US agencies. TRW does not itself represent clients before USCIS, the Department of Labor or US consulates. We coordinate with counsel on both sides so the worker, the employer and the documents stay aligned from the first offer to arrival in the US.
07Can a US company sponsor a Bangladeshi employee it has not yet met?
Yes. US employers often sponsor workers who are outside the US, provided the job is genuine, permanent and full-time, the labour market test is carried out properly and the worker meets the stated requirements. The employer must also be able to show ability to pay the offered wage from the priority date onward, through tax returns or accounts. We help US employers and their counsel verify a Bangladeshi candidate's qualifications and experience before the job requirements are finalised and recruitment begins, which reduces the risk of a refusal at the I-140 stage or a difficult EB-3 visa interview in Dhaka.
08What happens to my EB-3 visa case if my employer changes or withdraws the offer?
It depends mainly on timing and on the stage reached. If the employer withdraws before the I-140 is approved, the process generally has to restart with a new sponsor. After approval, and particularly after a petition has been approved for some time, the worker may keep the priority date for a later petition, although a new job offer and labour certification would usually be needed. Workers already in the US may have portability options at the adjustment stage. We review the position with US counsel and advise on protecting the priority date, current status and the family's wider plans.
From first call to resolution.
- 01
Offer and eligibility check
We verify the US employer, review the offer and any agency agreement, confirm the right EB-3 visa subcategory and check the worker's Bangladeshi qualifications and experience against the job requirements with US counsel before anything is paid.
- 02
Labour certification evidence
For the EB-3 visa file we gather, verify and translate degree certificates, registrations and experience letters, and support the employer's US counsel through the prevailing wage, recruitment and labour certification stages with prompt Bangladeshi evidence.
- 03
Petition and priority date
US counsel file the employer's I-140 petition, with premium processing where useful. We help respond to any evidence requests and monitor the Visa Bulletin so the worker is ready when the priority date becomes current.
- 04
Visa and relocation
We prepare civil documents for the National Visa Center and the Dhaka interview, brief the worker and family for the interview, and settle Bangladesh tax, employment exit, property and remittance matters before the worker leaves for the US.
