Islamic Inheritance Calculator for Bangladesh

This free Islamic inheritance calculator works out each heir's share of a Muslim estate under Hanafi Sunni law as applied in Bangladesh. It deducts funeral expenses, debts and any bequest, applies the Quranic shares, residuaries, exclusion, awl and radd, and gives effect to section 4 of the Muslim Family Laws Ordinance 1961 for the children of a son or daughter who died first. Results are shown as exact fractions, percentages and amounts in Taka.

How the law works

How Islamic inheritance works in Bangladesh

For Muslims, section 2 of the Muslim Personal Law (Shariat) Application Act 1937 makes Muslim personal law the rule of decision in intestate succession. The calculator follows the Hanafi school and the one statutory change that matters most in practice: section 4 of the Muslim Family Laws Ordinance 1961.

01 · Before the heirs

Payments first

Funeral expenses are paid first, then debts, including any unpaid dower owed to a widow. A bequest is paid next, limited to one third of what remains unless the heirs consent to more. Only the balance is shared.

02 · Ashab al-furud

Quranic sharers

Spouses, parents, grandparents, daughters, son's daughters and sisters have fixed shares of 1/2, 1/4, 1/8, 2/3, 1/3 or 1/6, set out in the Quran at 4:11, 4:12 and 4:176. Their shares change with who else survives.

03 · Asaba

Residuaries

What is left goes to the nearest male agnate (asaba bi-nafsihi), such as a son, father or brother. Daughters and sisters inherit with their brothers at half a male's share (bi-ghayrihi), and full or consanguine sisters take the residue alongside daughters (ma'a ghayrihi).

04 · Hajb

Exclusion

A nearer heir can shut out a more remote one completely (hajb hirman): a son excludes brothers, the father excludes the grandfather, and under Abu Hanifa's view the grandfather excludes brothers and sisters. Other heirs only reduce a share (hajb nuqsan), as children reduce a spouse's share.

05 · Awl and radd

Too much or too little

When fixed shares exceed the estate, all are cut in proportion (awl). When they fall short and no residuary exists, the surplus returns to the sharers in proportion (radd), but not to a husband or wife while another sharer survives.

06 · Bangladesh

Orphaned grandchildren

Under section 4 of the 1961 Ordinance, the children of a son or daughter who died before the deceased take, per stirpes, the share their parent would have taken if alive. Classical Hanafi law would often have excluded them.

Questions

Islamic inheritance calculator FAQ

Which law governs inheritance for Muslims in Bangladesh?

Section 2 of the Muslim Personal Law (Shariat) Application Act 1937 provides that, notwithstanding any custom or usage to the contrary, the rule of decision in questions of intestate succession where the parties are Muslims is the Muslim Personal Law (Shariat). The section excludes questions relating to agricultural land from its own wording, so land matters should be checked separately. Most Muslims in Bangladesh are Sunni and follow the Hanafi school, which is the school this calculator applies.

Do grandchildren inherit if their parent died before the grandparent?

Yes, in Bangladesh. Section 4 of the Muslim Family Laws Ordinance 1961 provides that where a son or daughter of the deceased dies before the succession opens, that child's children who are alive when it opens receive, per stirpes, a share equal to the share their parent would have received if alive. Under classical Hanafi law an orphaned grandchild could be excluded by a living uncle; section 4 changed that. The calculator treats the predeceased child as alive, works out that child's share and divides it among his or her children, a son taking twice a daughter's share.

Why does a son receive twice a daughter's share?

The Quran (4:11) provides that a son takes the portion of two daughters. Sons and daughters inherit together as residuaries, so the residue is divided in units of two for each son and one for each daughter. Where there is no son, daughters are Quranic sharers instead: one daughter takes 1/2 and two or more share 2/3, and they can receive more through the return (radd) where there is no residuary.

What is paid out of the estate before the heirs receive anything?

Funeral expenses are paid first, then the deceased's debts. A bequest (wasiyyah) is then paid, but only up to one third of what remains unless the heirs consent to more after the death. Under Hanafi law a bequest to someone who is already an heir needs the other heirs' consent. Only the balance is divided among the heirs, and the calculator applies these steps in that order.

What happens when the shares add up to more or less than the whole estate?

If the fixed shares exceed the estate, every share is reduced in proportion. This is called awl: for example, a wife, two daughters and both parents have shares of 3, 16, 4 and 4 parts out of 24, which add up to 27, so the estate is divided into 27 parts instead. If the shares come to less than the estate and there is no residuary, the surplus is returned (radd) to the sharers in proportion to their shares. Under Hanafi law a husband or wife does not share in the return while any other sharer is alive.

Can I use this calculator for a Shia family or for non-Muslims?

No. The calculator applies Hanafi Sunni rules. Shia (Ithna Ashari) law ranks heirs differently and treats matters such as the return to a spouse and the grandfather's position in another way. Hindus, Buddhists and Christians in Bangladesh are governed by their own personal laws. Complex estates, including those with distant kindred, missing persons, unborn children or disputes over who is an heir, also need individual advice.

DisclaimerThis calculator and the text on this page are general information, not legal advice. Results depend entirely on the facts entered and on the Hanafi rules described above. They do not deal with distant kindred, unborn or missing heirs, disqualification of an heir, gifts made during life, agricultural land questions or disputes about who is an heir. Before distributing property, applying for mutation or approaching a court, have the shares confirmed by a lawyer.
