Practical advice on Bangladesh immigration and visas

Bangladesh immigration rules affect almost every foreign investor and employer at some point. A senior engineer arriving for a factory commissioning, a regional director moving to Dhaka, a shareholder attending board meetings or a family member joining an expatriate employee each needs the right visa and, often, a separate work permit. Getting the category wrong can lead to refused entry, delayed salary payments, tax problems or fines on departure. TRW & Co advises companies and individuals on the whole process as part of our private client and employment practice, working closely with our corporate team.

The framework combines legislation, government policy and administrative practice. The Foreigners Act 1946 and related rules govern entry, stay, registration and departure. Visas are issued by Bangladesh missions abroad, increasingly through the government's online visa portal, and visa on arrival is available to eligible travellers at the discretion of immigration officers of the Special Branch. Extensions and changes of status inside the country are handled by the Department of Immigration and Passports. Because practice changes frequently, we confirm current official requirements for each case rather than relying on old checklists, which is where many Bangladesh immigration problems begin.

Employment is the area where most mistakes occur. A foreign national who will work in Bangladesh generally needs an employment visa and a work permit from the authority that regulates the employer. Since 23 August 2026, Invest Bangladesh has issued work permits that were previously handled by the former investment and economic zone authorities, while BEPZA continues to issue permits for export processing zone enterprises and the NGO Affairs Bureau covers foreign-funded NGOs. Security clearance from the Ministry of Home Affairs is usually part of the process. Employers should plan these steps before the employee travels, not after arrival.

Investors and business visitors have their own routes. Shareholders and directors of Bangladesh companies may qualify for investor or business categories, and genuine short visits for meetings, negotiations and site inspections usually fall under business visas rather than employment. Families of Bangladeshi origin can benefit from a No Visa Required (NVR) endorsement on a foreign passport or a dual nationality certificate, which allow long stays without repeated visa applications. We help clients choose the category that matches the real purpose of the visit, because a mismatch can become a serious Bangladesh immigration issue during renewal, tax filing or departure.

Compliance continues after arrival. Foreign employees must keep visas and work permits valid, renew them before expiry, report changes of employer or address where required, and pay income tax through their employer. Overstay can lead to fines and difficulties leaving the country, and directors with unresolved tax or legal issues may face travel restrictions. Our team, with founding partner Adv Syed Wahid on contentious matters and Barrister Tahmidur Rahman on investment matters, helps clients resolve Bangladesh immigration problems quickly. You can contact our Dhaka office to discuss an upcoming assignment or an existing difficulty.

01

Visa category assessment

We review the purpose, duration and nature of each visit and recommend the correct visa category, whether business, employment, investor, family or another route. We explain the documents the mission or portal will expect, including invitation letters, company documents and proof of investment. A correct choice at the outset avoids refusals, unnecessary re-entry and problems that surface later during Bangladesh immigration renewals or departure checks at the airport. We also prepare invitation letters.

02

Work permits and security clearance

We prepare and track work permit applications for employees of local companies, branch and liaison offices, economic zone and export processing zone enterprises and NGOs, working with Invest Bangladesh, BEPZA or the NGO Affairs Bureau as appropriate. We also follow security clearance through the Ministry of Home Affairs and advise employers on the documents, timelines and conditions that apply to each permit and renewal. We keep a record of each permit and its conditions for later renewals and Bangladesh immigration audits.

03

Extensions and changes of status

Foreign nationals already in Bangladesh often need to extend a visa, convert a business visa after an employment offer, or change employer. We prepare applications to the Department of Immigration and Passports, coordinate with the work permit authority and advise on timing so that status does not lapse. Where an application is refused or delayed, we review the reasons and help the client respond quickly and correctly. Clients should diarise visa and permit expiry dates well ahead and keep receipts for pending applications, so that lawful status can be evidenced if questioned.

04

NVR and dual nationality

Persons of Bangladeshi origin holding foreign passports, and their spouses and children, may be eligible for an NVR endorsement, while Bangladeshi-born citizens of certain countries can obtain a dual nationality certificate. We advise on eligibility, documents and the practical differences between these routes. These options can greatly simplify Bangladesh immigration for diaspora families who return often, own property or run businesses in Bangladesh. Supporting documents are checked carefully before filing.

05

Employer compliance programmes

For companies with several foreign staff, we design compliance calendars covering visa and permit expiry dates, renewal lead times, tax withholding, reporting obligations and exit formalities. We review employment contracts and assignment letters so that they match the approved permit, and we train HR teams on common risks. This reduces the chance that a single overlooked deadline will disrupt operations or damage the company's standing with regulators. Regular reviews keep Bangladesh immigration records accurate across the group.

06

Overstay, refusals and enforcement

When something has gone wrong, such as an overstay, a refused extension, an expired work permit, a travel restriction or an allegation of unauthorised work, we act quickly. We assess the legal position, prepare explanations and applications to the relevant authority, and advise on fines, regularisation and departure. Where Bangladesh immigration decisions are unlawful, our litigation team can consider judicial review before the High Court Division. Passports, entry stamps, permits and correspondence should be gathered at once, because the dates they show often decide the penalty and the options available.

01

Which Bangladesh immigration route does a foreign employee need to work here?

Foreign nationals employed in Bangladesh generally need an employment visa issued by a Bangladesh mission, supported by employer documents, followed by a work permit from the authority that regulates the employer, such as Invest Bangladesh, BEPZA or the NGO Affairs Bureau. Security clearance is usually required as well. Working on a business or tourist visa is not permitted and can lead to fines, cancellation and difficulties on departure. We advise employers on sequencing the visa and work permit steps so the employee starts work lawfully. Employers should keep copies of the approvals and visa papers for later renewals.

02

Can business visitors attend meetings without a work permit?

Short visits for meetings, negotiations, market research, training sessions and site inspections are generally possible on a business visa, without a work permit, provided the visitor is not taking up employment or receiving salary in Bangladesh. The line between business activity and work can be unclear, for example where a foreign engineer supervises installation or a consultant delivers a paid project. We review the planned activities against current Bangladesh immigration practice and recommend whether a business visa is enough or whether an employment route is needed, which protects both the visitor and the local host company.

03

Is visa on arrival available for business travellers?

Visa on arrival is available to eligible nationals for certain purposes, including business, but it is granted at the discretion of the immigration officer at the port of entry and depends on nationality, documents and current policy. Travellers usually need a return ticket, proof of funds, an invitation or supporting letter, and in some cases pre-arrival registration. Relying on visa on arrival for important trips carries risk, because a refusal at the airport can disrupt a deal or project. For senior executives and repeat visitors, we usually recommend obtaining a visa from a mission before travel.

04

How long does a work permit take in Bangladesh?

Processing time depends on the authority, the completeness of the application, security clearance and current workloads, so we do not promise a fixed timeline. Employers should start preparing several weeks before the employee is due to begin work, and longer where documents need legalisation abroad. Common causes of delay include inconsistent job titles, missing company documents, unclear salary information and incomplete security clearance forms. We prepare applications carefully, track their progress with the authority and update employers regularly, which tends to reduce delays in processing. Matching job titles, salary figures and company details across documents avoids many of these queries.

05

What is an NVR under Bangladesh immigration rules, and who can get one?

An NVR, or No Visa Required, endorsement allows certain foreign passport holders to enter and stay in Bangladesh without a separate visa. It is generally available to foreign nationals of Bangladeshi origin, and to their spouses and children, subject to documents proving the connection. The endorsement is obtained from a Bangladesh mission abroad or, in some cases, within Bangladesh. NVR holders should still check whether they need permission to work and must comply with other legal requirements. We advise diaspora families on whether an NVR or a dual nationality certificate better suits their circumstances and plans.

06

What happens under Bangladesh immigration law if a foreign national overstays?

Overstaying is a breach of Bangladesh immigration law and can lead to fines calculated by reference to the period of overstay, delays at departure and, in serious cases, further enforcement action. Overstay can also affect future visa applications and work permit renewals. The sensible approach is to deal with the issue before travelling, by applying to the Department of Immigration and Passports to regularise the position and pay any applicable fine. We help individuals and employers prepare the application, explain the circumstances and avoid last-minute problems at the airport, which can be costly and stressful.

07

Can a foreign investor obtain long-term residence in Bangladesh?

Bangladesh offers routes for investors to obtain longer-term visas and, in qualifying cases, residence or permanent residence, depending on the scale and nature of the investment and current government policy. Requirements and thresholds have changed over time and are applied through Invest Bangladesh and the Ministry of Home Affairs, so we confirm the current position for each client. Investors should keep clear records of inward remittance and share issuance, because these are central to Bangladesh immigration applications based on investment and to later repatriation of profits and sale proceeds. Records should be kept safe.

08

Do foreign employees pay tax in Bangladesh?

Yes. Foreign nationals employed in Bangladesh are generally liable to income tax on their Bangladesh employment income, and employers must deduct tax at source and report it. Residence status for tax purposes depends on the number of days spent in Bangladesh, and tax treaties may affect the position for some nationalities. Unpaid tax can create problems at departure and during permit renewal. We work with tax advisers so that employment terms, Bangladesh immigration status and tax compliance are aligned, and we review exit arrangements when a foreign employee finishes an assignment or changes employer.

How a matter runs

From first call to resolution.

  1. 01

    Assess purpose and route

We review who is travelling, why, for how long and for which entity, and identify the correct visa category, permit authority and supporting documents before any application is filed or travel is booked. This scoping avoids wasted effort.

  2. 02

    Prepare the application

We prepare forms, invitation letters, company documents and legalised certificates, check that job titles, salaries and dates are consistent, and file with the mission, the portal or the relevant authority. Every document is checked against Bangladesh immigration requirements.

  3. 03

    Track and respond

We follow the application through security clearance and authority review, answer queries promptly, and update the employer or individual so that travel, start dates and payroll can be planned. Queries are answered within days.

  4. 04

    Maintain compliance

We diarise renewals, advise on changes of employer or role, coordinate tax and exit formalities, and act quickly when an overstay, refusal or other Bangladesh immigration issue needs to be resolved. Records are kept for audit.

“Demonstrates an extraordinary command over both domestic litigation and international arbitration.”

FAQ

Questions, answered.

Still unsure? Email info@trw.co with a short outline of the matter.

Who handles Bangladesh immigration matters inside the country?
The Department of Immigration and Passports deals with visa extensions and changes of status, the Special Branch of the police operates immigration control at airports and land ports, and work permits are issued by Invest Bangladesh, BEPZA or the NGO Affairs Bureau depending on the employer. Security clearance involves the Ministry of Home Affairs. Knowing which body is responsible for each step avoids wasted applications and delays. We act as a single point of contact across these bodies, so that the employer does not need to manage several separate Bangladesh immigration processes alone.
Can a spouse of an expatriate employee work in Bangladesh?
A dependent spouse usually enters on a visa linked to the principal employee. If the spouse wishes to take up employment, a separate employment visa and work permit are normally required, supported by an employer in Bangladesh. Spouses of Bangladeshi citizens and persons of Bangladeshi origin may have other options, such as an NVR endorsement, though a work permit may still be needed for employment. We advise families on the best route for each family member's plans.
Does a liaison office need work permits for foreign staff?
Yes. Liaison, branch and representative offices of foreign companies operate under permission from the investment authority, now Invest Bangladesh, and foreign staff working for them generally need employment visas and work permits like other employers. The scope of permitted activity for a liaison office is limited, and staff duties should be consistent with that scope to avoid compliance problems during renewal or inspection. We also advise on converting a liaison office into a branch or subsidiary where business needs grow beyond its scope.
What documents are usually needed for a work permit?
Typical documents include the employee's passport and visa, appointment letter or contract, academic and professional certificates, the employer's incorporation and registration documents, evidence of tax registration, board resolutions and photographs. Some documents issued abroad must be attested or legalised. Requirements differ by authority and are updated periodically, so we provide a current checklist for each application to prevent avoidable returns and delays. Inconsistent information across documents is a common reason for delay. We check each document before it is submitted, so that the authority receives a complete and consistent file.
How does dual nationality affect Bangladesh immigration?
A Bangladeshi citizen who acquires citizenship of a permitted country can apply for a dual nationality certificate, which confirms continued Bangladeshi citizenship. With it, the person can enter and live in Bangladesh as a citizen, without visas, and hold property in their own name. Children born abroad may also qualify for citizenship by descent, subject to registration. We advise families on the procedure and the documents required. It is often the simplest long-term solution for Bangladesh immigration questions affecting returning families.
Can a visa be refused or cancelled?
Yes. Missions and immigration officers have discretion to refuse visas, and visas or permits can be cancelled for misrepresentation, unauthorised work, security concerns or breach of conditions. Reasons are not always given in detail. Where a refusal affects a business or family plan, we review the application, identify likely concerns and advise whether to reapply with better evidence, seek reconsideration or consider a legal challenge. Prompt, accurate responses usually produce the best outcome. Keeping copies of every application helps any later review.
What should employers do when a foreign employee leaves?
Employers should notify the work permit authority where required, settle final salary and tax, cancel or surrender the permit according to current practice, and make sure the employee's visa status allows a timely departure. Overlooking these steps can leave the company with compliance issues and affect future applications. We provide exit checklists that cover immigration, employment and tax obligations together. Good exit planning also protects the employee's ability to return to Bangladesh in future.
