Md. Ziaul Haque v Bangladesh Bank and others
Writ Petition 10141/2026 · Rule disposed of with direction · Decided 9 September 2026
The petitioner filed a writ petition under article 102 of the Constitution seeking a direction on the respondents to reschedule his loan liabilities, with waiver of all interest, in exercise of the power under section 49(1)(cha) of the Bank Companies Act, 1991 read with BRPD Circular No. 7 dated 16 September 2025. A Rule Nisi was issued on 11.08.2026. The petitioner's case was that on 06.07.2026 he had submitted a representation to respondent no. 1 asking for a direction on the bank concerned to reschedule his banking facilities in terms of that circular, but respondent no. 1 had not disposed of it. Considering the facts and circumstances and the submissions of the petitioner's advocate, the High Court Division took the view that justice would best be served for the present by directing respondent no. 1 to dispose of the representation dated 06.07.2026 in accordance with law. The Rule was disposed of with that direction and with no order as to costs.
- Whether, where the petitioner's representation for rescheduling of his loan liabilities remained undisposed of, the Court should direct rescheduling or direct the authority to decide the representation.
- A petitioner whose representation for loan rescheduling under BRPD Circular No. 7 of 2025 is left undisposed of may obtain a direction that the authority decide it.
- In the circumstances, justice would be best served for now by directing respondent no. 1 to dispose of the petitioner's representation dated 06.07.2026 in accordance with law.
- The Rule was disposed of with that direction and with no order as to costs.
we are of the view that the justice would be best served for now, if the respondent No. 1 is directed to dispose of the petitioner’s representation dated 06.07.2026 in accordance with law.
