D.H. Euro Hi Tech Co. (BD) Limited v Government of Bangladesh and others
Writ Petition 12719/2024 · Rule discharged as infructuous · Decided 17 May 2026
The petitioner company applied under article 102 of the Constitution, and on 05.11.2024 a Rule Nisi was issued calling on the respondents to show cause why their inaction in disposing of its application dated 18.08.2024 should not be declared illegal and without lawful authority. Respondent No. 4 applied for the Rule to be discharged, informing the Court that, after receiving the Court's direction, respondent No. 2 had disposed of the representation in January 2025, stating that there was no scope to consider the petitioner's prayer under the existing law. Respondent No. 2 agreed. No one appeared for the petitioner, although a copy of the application had been served on 10.07.2025 and the matter had appeared in the list for several days. The High Court Division noted that the Rule had been issued on the allegation that the representation was not being disposed of, and that it had since been effectively disposed of. It held that the Rule had become infructuous and discharged it.
- Whether a Rule challenging the respondents' inaction in disposing of the petitioner's representation survived once the representation had been disposed of.
- A Rule issued on the allegation that the respondents were not disposing of a representation becomes infructuous once the representation has been effectively disposed of after issuance of the Rule.
- The Rule was accordingly discharged.
- The Court proceeded to decide the application to discharge the Rule although no one appeared for the petitioner, who had been served with a copy of it.
The Rule was issued on the allegation that the respondents are not disposing of the representation dated 18.08.2024 and after issuance of the Rule, the said representation has been effectively disposed of on 21.01.2025
