Supreme Court Judgments, Summarised

by Barrister Tahmidur Rahman | Nov 3, 2026

Summary

OK Mobile Limited obtained a Rule under article 102 of the Constitution asking why respondent No. 1 should not be directed to dispose of its application dated 25.11.2025 in accordance with law. When issuing the Rule, the High Court Division directed respondent No. 1 to dispose of that application within 60 days. Respondent No. 4, Shahjalal Islami Bank PLC, then informed the Court that respondent No. 1, by email, had directed it to address the petitioner's grievance by providing the necessary information and documents, and that it had provided a statement of account issued on 03.02.2026. The petitioner argued that the statement did not reflect the true picture of its deposits and loan repayments and sought a further direction for a correct statement. The Court held that, with the application disposed of, the Rule had become infructuous. On the dispute over the statement, it observed that the petitioner may raise its grievance in the proper forum if so advised, and disposed of the Rule without costs.

Issues

  1. Whether the Rule seeking a direction to dispose of the petitioner's application of 25.11.2025 survived once that application had been dealt with.
  2. Whether the Court should give a further direction for a correct statement of account where the petitioner disputed the statement provided.
Key points

  • Once the application that the Rule sought to have disposed of had been dealt with, the Rule became infructuous.
  • A complaint that a bank's statement of account does not reflect the true transactions is a grievance for the petitioner to ventilate in the proper forum, not a ground for a further direction in this Rule.
  • The Rule was disposed of with that observation and without any order as to costs.

we are of the further view that in that case the petitioner may ventilate his grievance in proper forum if he is so adviced.
