High Court Division · Special Original Jurisdiction
Meherun Nesa and others v Government of the People's Republic of Bangladesh and others
Writ Petition 2334/2018 · Rule made absolute · Decided 4 August 2026
The petitioners, teachers and staff of Patgudam Girls High School, Mymensingh, were included in the Monthly Payment Order (MPO). Because of a dispute between the school's Managing Committee and the Headmaster-in-Charge, their salary sheets were not sent to the Directorate of Secondary and Higher Secondary Education, and their salaries for various periods between 2013 and 2015 were not paid. Their application of 18.10.2017 for arrear salary produced no step by the respondents. Five other teachers of the school had succeeded in Writ Petition No. 3304 of 2014, in which the High Court Division on 19.11.2017 directed payment of their arrear and regular salary, and they were paid. The petitioners challenged the respondents' inaction under Article 102 of the Constitution, and no one opposed the Rule. The High Court Division held that the petitioners stood on the same footing as the earlier petitioners and were equally entitled to the government portion of their arrear salary. The Rule was made absolute, with a direction to pay within one month.
- Whether the respondents' inaction in paying the petitioners' arrear salary was unlawful.
- Whether the petitioners were entitled to the same relief as the teachers who succeeded in Writ Petition No. 3304 of 2014.
- Employees who stand on the same footing as the successful petitioners in an earlier writ petition are equally entitled to the same relief.
- The petitioners were entitled to the government portion of their arrear salary, which had not been paid because of a dispute between the Managing Committee and the Headmaster-in-Charge.
- The respondents were directed to pay the petitioners' arrear salary within one month of receiving the judgment, with no order as to costs.
It appears that the petitioners stand on the same footing along with the petitioners of Writ Petition No. 3304 of 2014.
