High Court Division · Special Original Jurisdiction
Sahinul Islam v Government of Bangladesh and others
Writ Petition 6454/2024 · Rule disposed of with directions · Decided 12 August 2026
The petitioner, defendant No. 1 in Artha Rin Case No. 439 of 2020, challenged Order No. 20 dated 15.05.2024 of the Artha Rin Adalat in Dhaka, which rejected his application for time to submit a written statement. A Rule Nisi was issued on 27.05.2024 with an interim order of stay. Before the High Court Division, the petitioner stated that his written statement was ready, and the bank, respondent No. 3, stated that it had no objection to the written statement being accepted. The High Court Division took the view that justice would best be served by directing the Adalat to accept the written statement and proceed towards expeditious disposal of the suit. It directed the petitioner to submit his written statement within one month, failing which the Adalat could proceed without allowing him unnecessary accommodation. The Adalat was directed to accept the written statement if filed, withdraw the suit from ex parte and proceed expeditiously in accordance with law. The Rule was disposed of and the interim stay recalled.
- Whether the defendant in an Artha Rin suit should be allowed to file his written statement after his application for time to do so was rejected.
- With the respondent bank conceding, the defendant was directed to submit his written statement in the Artha Rin case within one month.
- If the written statement was not filed within that time, the Artha Rin Adalat was at liberty to proceed with the suit without allowing the defendant any unnecessary accommodation.
- On the written statement being filed, the Adalat was to accept it, withdraw the suit from ex parte and proceed expeditiously in accordance with law.
- The Rule was disposed of with these directions and the interim order of stay was recalled.
The Artha Rin Adalat No. 1, Dhaka is hereby directed to accept the written statement, if so filed and withdraw the suit from ex-parte and to proceed with the suit in accordance with law expeditiously.
