High Court Division · Special Original Jurisdiction
M.A. Khalaque (Pvt.) Limited v The Government of Bangladesh and others
Writ Petition 8109/2025 · Rule discharged as infructuous · Decided 13 September 2026
The petitioner company sought a term loan of Tk 12,00,00,000 from Sonali Bank PLC, respondent No. 5, on a 60:40 debt-equity ratio for five years, by an application dated 12.05.2025. It filed a writ petition under Article 102 of the Constitution and, on 21.05.2025, obtained a Rule Nisi calling on the respondents to show cause why the failure of respondent No. 2 to direct the bank to grant the loan by disposing of the application should not be declared to have been done without lawful authority and of no legal effect. Later, by filing an application, the learned Senior Advocate for the respondent informed the Court that, as directed by the Court, respondents Nos. 2 and 5 had disposed of the petitioner's application and that the Rule had therefore become infructuous. Considering the submission and the facts and circumstances, the High Court Division allowed the application and discharged the Rule as infructuous, making no order as to costs and directing that the order be communicated at once.
- Whether a Rule against the failure to dispose of the petitioner's term loan application survived once that application had been disposed of.
- The Rule challenged the failure of respondent No. 2 to direct Sonali Bank PLC to grant the petitioner company a term loan of Tk 12,00,00,000 on a 60:40 debt-equity ratio for five years by disposing of its application dated 12.05.2025.
- As directed by the Court, respondents Nos. 2 and 5 disposed of the petitioner's application, and with that disposal the Rule became infructuous.
- The application filed for the respondent was allowed and the Rule was discharged as infructuous, with no order as to costs.
Considering the submission and facts and circumstances, the application is allowed. Accordingly, the Rule is discharged as being infructuous. No order as to cost.
