What may count as domestic violence under Bangladesh law?
For its purposes, the Domestic Violence (Prevention and Protection) Act, 2010 defines domestic violence as physical, psychological, sexual or economic abuse committed against a woman or child by a person in a defined family relationship. The definitions provide further detail on psychological abuse and economic loss. Whether the Act applies in a particular situation depends on the relevant facts and current law.
Can a court make a protection order before the other person is heard?
Following an application, the Act allows a court to make an interim protection order on an ex parte basis if the statutory conditions are met. It also provides for notice and an opportunity for the respondent to show cause before a protection order is considered. The court retains discretion, and an order is not automatic.
Does temporarily living elsewhere prevent a domestic-violence application in Bangladesh?
The Act includes the place where an aggrieved person is temporarily residing among possible venue bases for an application. It also addresses residence in a shared residence and residence orders. The appropriate court, available relief and any property consequences depend on the facts and applicable law.
