01 / The question

The right route depends on the facts, documents, jurisdiction and procedural setting..

01

1. A Bangladesh producer is losing market share as imports increase

A producer or industry group may be considering whether the facts warrant a Bangladesh trade-remedy route. The work starts with product definition, import data, domestic-industry position, pricing, sales, capacity, profitability and other evidence relevant to injury and causation—not with an assumption that low-priced imports establish dumping.

02

2. A Bangladesh-connected exporter receives an overseas investigation notice

An overseas authority’s notice can trigger short response windows and detailed requests on sales, costs, production, corporate structure and origin. The immediate task is to preserve and organise the record, understand the importing market’s procedure and coordinate commercial and legal responses without treating an investigation as the same thing as a WTO dispute.

03

3. An importer or buyer must operate under a new or proposed measure

A provisional or final measure can affect landed cost, supply commitments, pricing and customs clearance. The relevant questions may include product coverage, country of origin, effective dates, notice terms, available review routes and how risk is allocated in supply contracts. Those questions should be considered against the current instrument, not a generic tariff label.

02 / What may matter

Read the detail before the route.

Each matter turns on its documents, jurisdiction, legal framework and procedural setting. These are questions to assess—not promises of a result.

01

1. Remedy assessment and case framing

Assess the product, countries, market facts and governing route; distinguish an anti-dumping, countervailing or safeguard question from ordinary customs, tax or commercial-pricing issues; and identify the authority, procedural posture and next decision point.

02

2. Evidence, data and submission coordination

Organise the record that may be relevant to standing, product scope, normal value, subsidy, imports, price effects, injury, causation or serious injury. Coordinate legal analysis with finance, sales, production, procurement and supply-chain teams while maintaining appropriate confidentiality controls.

03

3. Investigation and measure response

Prepare for notices, questionnaires, interested-party submissions, hearings, provisional measures, undertakings and final determinations as applicable. Help translate the legal process into an operational response for exporters, foreign producers, importers and domestic industry participants.

04

4. Implementation, review and dispute-pathway planning

Review the implications of a current measure for customs treatment, contracts and supply arrangements; assess review, expiry, variation or challenge questions under the applicable framework; and identify when a matter calls for domestic-process advice rather than a state-to-state WTO pathway.

03 / Context

Specific law. Wider horizon.

Bangladesh’s Customs Act, 2023 provides separate statutory routes for countervailing, anti-dumping and safeguard duties. The official consolidated text records, among other matters, the Government’s power to impose anti-dumping duty on recommendation of the Bangladesh Trade and Tariff Commission where goods are exported below normal value and a similar domestic industry is damaged or likely to be damaged. It also provides a prima facie evidence gateway before anti-dumping proceedings commence, and recognises Gazette notification and review mechanisms in the statutory scheme.[^bd-customs] That domestic framework sits alongside international trade rules. The WTO agreements regulate how Members may use trade remedies; they do not turn every commercial disagreement, price difference or subsidy allegation into a company-level remedy. In particular: – anti-dumping analysis involves dumping, material injury and causation under the relevant framework; – countervailing measures concern subsidised imports, domestic-industry injury and causation; and – safeguard measures require increased imports and serious injury or threat, following an investigation with procedural protections for interested parties.[^wto-ad][^wto-scm][^wto-sg] For Bangladesh-connected businesses, the practical implication is that the applicable national instrument and process in the relevant importing or importing-cou
