High Court Division · Special Original Jurisdiction
Md. Mofiz Uddin v Government of Bangladesh and others
Writ Petition 12854/2025 · Rule discharged as infructuous · Decided 6 September 2026
The petitioner applied to the High Court Division under article 102 of the Constitution. On 08.12.2025 a Rule Nisi was issued calling on the respondents to show cause why respondent No. 2 should not be directed to dispose of the petitioner's application dated 21.08.2025 in accordance with law. Respondent No. 4 then filed an application informing the Court that, in the meantime, it had disposed of the application dated 21.08.2025 and had rescheduled the petitioner's loan liability. Its counsel submitted that the Rule had therefore become infructuous. Considering the submission and the facts and circumstances, the Court allowed respondent No. 4's application. Since the application dated 21.08.2025 had already been disposed of and the loan rescheduled, the Rule seeking its disposal had become infructuous. The Rule was accordingly discharged as being infructuous, with no order as to costs, and the order was directed to be communicated at once.
- Whether a Rule seeking a direction to dispose of the petitioner's application survived once the application had been disposed of and the loan liability rescheduled.
- Where the respondent has disposed of the petitioner's pending application and rescheduled the loan liability, a Rule seeking a direction to dispose of that application becomes infructuous.
- Respondent No. 4's application informing the Court of the rescheduling was allowed.
- The Rule was discharged as being infructuous, with no order as to costs.
By filing an application the respondent No. 4 apprises this Court that in the meantime it has rescheduled the loan liability of the petitioner upon disposing of the application dated 21.08.2025
