Supreme Court Judgments, Summarised

by Barrister Tahmidur Rahman | Nov 3, 2026

Summary

The petitioner was appointed in 2002 as temporary Nikah Registrar for three unions in Rawjan, Chittagong, one of which was later curtailed. He challenged a 2015 notice of the Sub-Registrar, Rawjan to prepare a panel for appointing a Nikah Registrar for No. 9 Pahartali Union, and obtained interim orders. The added respondent cited the petitioner's earlier Writ Petition No. 4394 of 2005, in which the respondents had been directed to grant him a regular licence for No. 8 Kadalpur Union only, since under Rule 10 of the Muslim Marriage and Divorce (Registration) Rules, 1975 a Nikah Registrar cannot be licensed for more than one union. The High Court Division found that he obtained the Rule through a different lawyer while concealing that judgment and continued to act in two unions in violation of the law. It discharged the Rule, imposed costs of Tk. 5,00,000, directed him to deposit the government fees earned for No. 9 Pahartoli Union since 14.08.2015, and vacated the interim orders.

Issues

  1. Q1

Whether the petitioner could continue to act as Nikah Registrar for No. 9 Pahartali Union in addition to No. 8 Kadalpur Union under interim orders of the Court.

  2. Q2

Whether the petitioner, who obtained the Rule and interim orders without disclosing an earlier judgment in his own writ petition, was entitled to relief.

Key points

  • In the petitioner's earlier Writ Petition No. 4394 of 2005 the respondents were directed to license him as a regular Nikah Registrar for No. 8 Kadalpur Union only, as under Rule 10 of the 1975 Rules a Nikah Registrar cannot be licensed to act for more than one union.
  • The petitioner, having been held entitled in an earlier writ petition to a regular licence for No. 8 Kadalpur Union only, misled the Court by obtaining the Rule and interim orders without disclosing that judgment.
  • By extending the status quo order, the petitioner continued to act as Nikah Registrar in two unions at a time in violation of the mandatory provision of law.
  • For misleading the Court, the petitioner was ordered to pay costs of Tk. 5,00,000 and to deposit within 30 days all government fees earned as Nikah Registrar for No. 9 Pahartoli Union since 14.08.2015.

Hence this Hon’ble Court came to unanimous decision to cost upon the instant petitioner Tk. 5,00,000/- (Five Lac) only for misleading the court regarding the earlier directions of this Hon’ble court
