Supreme Court Judgments, Summarised

by Barrister Tahmidur Rahman | Nov 3, 2026

Summary

The Bangladesh Water Development Board dredged the Surma River and stacked the sand at dykes near Sylhet. After a first tender drew no takers, M/S Abdul Malek Enterprise sought to buy the sand of Dyke Nos. 2 and 3 at the government rate and, in its writ petition, obtained a direction that its application be disposed of. In a second tender, Md. Kibria Helal was highest bidder for Dyke No. 3. Citing the Court's direction, the Executive Engineer issued a work order of 09.09.2025 to Abdul Malek Enterprise, which Kibria Helal challenged; the Board's counsel conceded the order had been misquoted. The High Court Division held that under sections 10 and 11 of the 2010 Ain balumahals must be leased by open auction, with khas collection only where leasing is not possible, so selling the sand by khas collection during a pending tender was unjustified. As most of Dyke No. 2's sand had been removed, it directed a work order for Dyke No. 3 in Kibria Helal's favour.

Issues

  1. Q1

Whether the Bangladesh Water Development Board lawfully issued a work order selling dredged sand from two dykes beside the Surma River to one trader at the government rate while a tender process for the same sand was pending.

  2. Q2

Whether the highest bidder in the pending tender was entitled to a work order for the sand.

Key points

  • Under sections 10 and 11 of the Balumahal o Mati Byabosthapona Ain, 2010, all balumahals must be leased out through open auction, and sand may be sold by khas collection only if leasing through auction is not possible.
  • Selling the sand of the dykes by khas collection while a tender process for the same sand was going on was not justified in law or in the circumstances.
  • The order of 03.08.2025 in Writ Petition No. 7199 of 2025 only directed the authorities to dispose of the trader's application within 30 days, and the Board's counsel conceded that the work order had misquoted it.
  • Having regard to the removal of most of the sand of Dyke No. 2 and the environmental pollution caused by the dumped sand, the Executive Engineer was directed to give a work order for the sand of Dyke No. 3 to the highest bidder within three days.
  • The Rule in Writ Petition No. 17114 of 2025 was made absolute in part, the stay was vacated, and the Rule in Writ Petition No. 7199 of 2025 was disposed of.

From the plain reading of the above provision, it is clear that all Balumahal shall be leased out through open auction and if it is not possible to lease through auction out then sand can be sold out by collecting Khas.
