How we guide clients through BSTI certification
The Bangladesh Standards and Testing Institution (BSTI) is the national standards body, operating under the Ministry of Industries and the Bangladesh Standards and Testing Institution Act 2018. For a wide range of food, cosmetic, electrical, chemical, construction and consumer products listed as mandatory, BSTI certification is a legal condition for manufacturing, importing, selling or distributing the product in Bangladesh. Without a valid certification mark licence or import clearance, goods can be held at port or seized from shelves. We advise manufacturers, foreign brands, importers, distributors and retailers at every stage, within our regulatory practice.
For domestic manufacturers, the core requirement is a certification marks (CM) licence for each product covered by the mandatory list. The process typically involves an application with company and factory documents, a factory inspection, sample collection, testing against the relevant Bangladesh Standard, payment of fees and grant of a licence allowing the BSTI mark to be used on the product. Licences are subject to conditions, surveillance and renewal. The list of mandatory products, the applicable standards and fee schedules can change through government notifications, so we confirm the current position for each product before an application is prepared.
Importers face a different but related process. Where an imported product falls within the mandatory list, customs clearance generally depends on BSTI testing and clearance or another accepted route, and goods may remain in port storage while samples are tested. Delays can create heavy demurrage, port rent and lost sales, particularly for food and seasonal goods. We help importers check whether their goods require BSTI certification before shipment, prepare documents, liaise with BSTI and customs, and respond quickly when test results are disputed or clearance is refused, so that consignments are not abandoned or destroyed unnecessarily.
BSTI also enforces labelling and packaging requirements, and the Standards of Weights and Measures Act 2018 governs net quantity declarations, measuring instruments and packaged commodities. Market surveillance, often carried out with mobile courts, can lead to fines, seizure and suspension of licences, and adverse publicity can damage a brand overnight. Adv Syed Wahid, our founding partner, leads enforcement defence and litigation through our dispute resolution practice, including challenges to unlawful orders before the High Court Division. We help clients respond to notices, contest test results and restore their products to the market. BSTI certification problems rarely resolve themselves.
Foreign brands entering Bangladesh need a joined-up plan. BSTI certification interacts with import policy, food safety rules administered by the Bangladesh Food Safety Authority, drug and cosmetics regulation where relevant, customs classification and trade mark protection. Foreign investors setting up local production also deal with Invest Bangladesh, which replaced BIDA and BEZA on 23 August 2026. Barrister Tahmidur Rahman and Barrister Remura Meheruba Mahbub advise on market entry, distribution and manufacturing structures, working with counsel in the UK, US, UAE, China, India and Singapore. We make BSTI certification part of the launch timetable.

Mandatory list assessment
We review product specifications, HS codes and intended uses against the current list of products requiring BSTI certification, and identify the applicable Bangladesh Standard. Where classification is unclear, we prepare reasoned analysis and, if needed, seek clarification from BSTI. Clients then know before production or shipment whether they need a CM licence, import clearance, both or neither, and what testing will be required. BSTI certification needs are recorded in a simple product matrix.
CM licence applications
We prepare certification marks licence applications for manufacturers, assembling corporate and factory documents, product information and labels, and coordinate factory inspection and sample collection. We follow up on testing and queries until the licence is granted, and we advise on licence conditions, use of the BSTI mark on labels and packaging, surveillance visits, renewal deadlines and changes to products, sizes or factory locations that may require fresh approval. Licence conditions are explained to production staff.
Import clearance support
We advise importers on BSTI certification requirements before goods are shipped, including documents from overseas manufacturers, labelling in Bangla and English, and test reports. When goods arrive, we coordinate with clearing agents, customs and BSTI on sampling and testing, and act quickly where results are delayed or adverse, including requests for retesting and arrangements for re-export where release is refused. Port timelines for BSTI certification are monitored daily.
Labelling and weights and measures
We review labels and packaging for compliance with BSTI standards, food and consumer labelling rules and the Standards of Weights and Measures Act 2018, including product name, ingredients, net quantity, manufacturing and expiry dates, importer details, price and mark use. We also advise on registration of packaged commodities and on verification of weighing and measuring instruments used in trade by retailers and manufacturers. Mandatory label content and language requirements should be confirmed before packaging is printed, to avoid costly reprinting.
Testing disputes and enforcement
Where a sample fails a test, a licence is suspended or a mobile court acts, we review sampling procedure, chain of custody, testing methods and the legal basis for the action. We prepare replies, request retesting where permitted, represent clients at hearings and pursue appeals or writ petitions. We also advise on recalls, communication with distributors and retailers, and protection of the brand's reputation. BSTI certification is restored as quickly as possible.
Market entry and distribution
We help foreign brands plan entry into Bangladesh, combining BSTI certification with import registration, trade mark filings, distribution and agency agreements, food safety and other sector rules. We draft distributor contracts that allocate responsibility for certification, labelling, recalls and regulatory penalties, so that the brand owner and local partners understand who must hold each approval and who bears the cost of non-compliance. The distribution or licence agreement should state who applies for, holds and renews each certificate or approval.

Meet the firm →01How do I know whether my product needs BSTI certification?
Check whether the product appears on the current list of products for which certification is mandatory, which is set and amended by government notification. The list covers many food items, cosmetics and toiletries, electrical goods, construction materials and chemicals, among others. Matching depends on product description and sometimes HS code, and borderline products can be difficult to classify. We review the product, its composition and intended use against the latest list and standards, and give a clear written view on whether BSTI certification, import clearance or another approval is required.
02What is a CM licence and who needs one?
A certification marks licence authorises a manufacturer to use the BSTI standard mark on a product that meets the relevant Bangladesh Standard. Local manufacturers of products on the mandatory list need a CM licence before producing and selling those products, and some businesses obtain licences voluntarily for products outside the list. The licence is product-specific and linked to the factory where the product is made. We prepare applications, coordinate inspections and testing, and advise on keeping the licence valid through surveillance and renewal. Each BSTI certification licence should be tracked.
03Can imported goods be released before BSTI testing is complete?
Generally, goods subject to mandatory BSTI certification are not released for sale until clearance is obtained, although procedures for sampling, testing and release can vary by product and port and may change over time. Delays can be costly, so preparation before shipment is essential. In appropriate cases, there may be scope to discuss interim arrangements with customs and BSTI, such as storage under bond. We advise importers on current procedures and on practical steps to reduce delay, including providing complete documents and accredited test reports with the shipment. Port storage costs add up quickly.
04What can we do if a product sample fails a BSTI test?
First, obtain the test report and details of how the sample was taken, stored and tested. Check whether the correct standard and method were applied and whether the sample was representative of the batch. Depending on the rules and the stage of the process, it may be possible to request retesting or present evidence from accredited laboratories. Commercially, consider whether the batch can be corrected, relabelled or re-exported. We review the technical and legal position quickly and prepare submissions to BSTI or customs to protect the consignment and the licence.
05How long is a BSTI certification licence valid?
CM licences are granted for a stated period and must be renewed before expiry, subject to continued compliance, surveillance and payment of fees. The validity period and renewal procedures are set by the applicable rules and may change, so the current terms should be checked when a licence is granted or renewed. Producing or selling a mandatory product after a licence has expired can lead to enforcement action. We help manufacturers maintain a register of licences and renewal dates across products and factories, and prepare renewal applications in good time.
06What penalties apply for selling uncertified products?
Manufacturing, importing or selling a mandatory product without valid BSTI certification, misusing the BSTI mark or failing labelling and weights and measures requirements can lead to fines, imprisonment in serious cases, seizure and destruction of goods, and suspension or cancellation of licences under the Bangladesh Standards and Testing Institution Act 2018 and related laws. Mobile courts frequently impose penalties on the spot. We advise on exposure, represent businesses before mobile courts and authorities, and challenge orders that were made without proper legal basis or procedure.
07Do foreign manufacturers need a separate BSTI certification for exports to Bangladesh?
Foreign manufacturers do not usually hold a Bangladesh CM licence themselves unless they manufacture locally. Instead, the importer obtains clearance for each consignment or follows the applicable process for imported mandatory products. Foreign test reports and certificates can help but may not replace BSTI testing. Labels must meet Bangladesh requirements, including importer details. We advise foreign brands and their importers on how to structure supply so that documents, labels and test evidence are ready before goods leave the factory. BSTI certification planning should begin before production. Supplier cooperation is important at every stage.
08Does BSTI certification replace food safety or drug approvals?
No. BSTI certification is one requirement among several. Food businesses may also need registration or approval under food safety law administered by the Bangladesh Food Safety Authority, while medicines, some cosmetics and medical devices fall under drug regulation. Electrical and telecom equipment may need other approvals. Each regime has its own process and timing. We map all the approvals needed for a product, identify overlaps and sequence applications so that the product can be lawfully imported, manufactured and sold without gaps. Missing one approval can delay the whole launch.
From first call to resolution.
- 01
Classify the product
We review product details, HS codes and labels against the mandatory list and Bangladesh Standards, and confirm whether BSTI certification, import clearance or other approvals apply before production or shipment. The summary lists the applicable standards, the documents required and any gaps to close before production or shipment. Where the rules are unclear, we suggest confirming the position with BSTI before committing to orders.
- 02
Prepare the file
We assemble corporate, factory and product documents, overseas test reports and compliant labels, and prepare applications so that inspection, sampling and testing can proceed without avoidable queries. Test reports, invoices, product specifications and labels are compared for consistency before anything is submitted. Foreign-language reports are translated where needed so that the authority can review them without delay.
- 03
Manage approval
We liaise with BSTI, customs and clearing agents through inspection, sampling, testing and grant of the licence or clearance, and act quickly on any query, delay or adverse result. You receive short updates at each stage, including inspection dates, test results and any queries raised. Response deadlines for queries are diarised so that no application lapses through delay.
- 04
Maintain and defend
We track renewals, surveillance and product changes, advise on labelling updates, and defend clients in testing disputes, mobile court actions and appeals when enforcement action is taken. BSTI certification records are kept current.
