1. A treaty, multilateral or interstate issue requires an authorised State position
A ministry or authorised public body may need to assess a treaty obligation, a request for consultations, an international-organisation process, a foreign State communication or a prospective interstate route. The immediate need may be to identify the operative instrument, procedural preconditions, reservations or declarations, the correct institutional channel and the evidence needed to support the State’s position.
2. A State measure is challenged in a cross-border investment or commercial context
A State or public entity may face a notice, assertion of a treaty claim, contractual arbitration issue or connected domestic proceeding. The mandate may require a joined-up view of the State measure, the relevant agency or entity, the investment or contract record, the applicable consent architecture, deadlines and any diplomatic or regulatory engagement. An investor–State matter, a private commercial dispute and an interstate dispute have different parties and consent structures even where the project facts overlap.
3. External proceedings or communications intersect with sovereign functions
A foreign request, procedural notice, information demand, proposed court step or public communication may affect a ministry, mission or State-linked body. The question may concern the proper recipient, authority to respond, record preservation, coordination with appropriate public institutions, and the separation of legal process from diplomatic channels. Questions about a diplomatic agent’s status, a State’s jurisdictional immunity and measures directed at property are distinct and should not be treated as one issue.

1. Mandate, authority and stakeholder map
Identify the instructing authority, the relevant State body or representative, the decision-makers, any required internal approvals and the information-handling protocol. Establish an accountable working structure that preserves the distinction between legal advice, formal State action and external communications.
2. Instrument, forum and procedural assessment
Map the treaty, agreement, statute, institutional rules or procedural instrument that may govern the issue. Review party status, consent, jurisdictional language, preconditions, notice requirements, time limits and available non-contentious or contentious routes without assuming that one framework answers all questions.
3. State record and position development
Organise the chronology, legal materials, official decisions, correspondence, technical evidence and relevant public-interest considerations. Coordinate a legally consistent position across the institutions that hold the necessary record, while applying appropriate safeguards for confidential, security-sensitive or privileged material.
4. Representation strategy, engagement and implementation
Plan the sequence for authorised engagement, consultations, negotiation, mediation, tribunal or court-facing steps where applicable, and communications with relevant stakeholders. Align the procedural response with the State’s defined objective, risk tolerance and any implementation or compliance questions that may follow.

### Bangladesh’s international-law setting needs instrument-specific analysis Article 25 of the Constitution of the People’s Republic of Bangladesh states that the State shall base international relations on, among other principles, respect for national sovereignty and equality, peaceful settlement of international disputes, respect for international law and the principles of the UN Charter. That constitutional provision is important context; it does not by itself supply consent to a court, tribunal or treaty mechanism.
