Family Mediation & Settlement
A considered route through family disagreement, settlement and the formal steps that may follow. We help you assess the process, frame the issues and build documentation that reflects what has been agreed.

The starting point
Choose the route before negotiating
the terms
Family disagreement calls for more than a preference for agreement. The relevant claim, any existing proceeding, the applicable personal law, the ability of each person to participate freely and the documents already in place can all affect the right next step. In Bangladesh, the route may involve pre-case Legal Aid mediation, settlement opportunities within Family Court proceedings or carefully managed private negotiations followed by appropriate formalities.
Define the legal and practical issues
Separate immediate arrangements from the questions that require formal resolution. Dissolution of marriage, restitution of conjugal rights, dower, maintenance, and a child’s guardianship or custody sit within the Family Court framework, subject to the applicable law.Family settlement is not a catch-all route for inheritance, immigration, criminal allegations, protective relief or every financial issue arising from a relationship.
Test suitability and select the pathway
Consider whether a facilitated process is appropriate and whether a statutory pre-case Legal Aid mediation route may be relevant before court. Where proceedings are underway, settlement can also be considered within the Family Court process alongside a coherent position if agreement is not reached.A procedural mediation route does not mean that joint discussion is suitable, safe or voluntary in every situation.
Build terms that can be carried forward
Translate discussion into a clear issue map, evidence base and written terms, then identify the signatures, certification, registration, court steps or document-authentication work that may be needed to give those terms their intended effect.A conversation or informal agreement does not, by itself, complete a divorce, alter parental status or carry the effect of every formal order or registered record.
A focused conversation
A structured approach to
family settlement
The focus is on process discipline: identifying what can be discussed, selecting an appropriate route, preparing the material needed for informed negotiation and mapping the steps required after terms are reached. The work can be shaped around the immediate decisions that matter most while keeping legal status, procedure and evidence in view.
Suitability, safety and pathway triage
Assess the issues, urgency and conditions for meaningful participation; identify whether separate arrangements, a different process or an urgent protection or court route should take priority.Pre-case Legal Aid mediation preparation
Prepare an issue map, supporting material, proposed terms and a process plan for a potential Legal Aid Office mediation route, distinguishing statutory requirements from informal communications.Family Court settlement strategy
Consider settlement opportunities in a pending Family Court matter, including the court’s pre-trial and post-evidence settlement stages, while preserving a coherent procedural position if no agreement is reached.Separation and relationship-transition terms
Structure discussion of living arrangements, communication, transition steps and legally relevant next actions without treating a settlement discussion as the legal completion of a divorce or separation.Dower and maintenance arrangements
Develop evidence-led proposals and payment structures concerning dower and maintenance, with careful attention to implementation, records and the formality needed for the route in use.Children, guardianship and custody arrangements
Frame practical arrangements for a child’s day-to-day care, communication, education, travel and change-management while identifying guardianship or custody questions that require formal handling.Settlement documentation and cross-border elements
Coordinate written terms with relevant signatures, certification, registration, court procedure, marriage or divorce records, document authentication and specialist analysis where overseas residence, travel, assets, orders or records are involved.Bangladesh context
Understanding the Bangladesh framework
Bangladesh family settlement is shaped by both process and formality. The Family Courts Act, 2023 identifies specific family matters within the court’s jurisdiction and incorporates settlement efforts at defined stages of the proceedings. The Legal Aid Services framework, amended in 2026, may require an initial pre-case mediation application to the Legal Aid Office for scheduled disputes before an action is brought if mediation does not resolve the matter. The route and effect of any agreement depend on the claim, procedural stage, applicable law and the required formalities.
A pre-case gateway may apply
For matters covered by the statutory schedule, the Legal Aid framework provides for an initial pre-case mediation application. If mediation fails, the prescribed report is relevant to the subsequent court route; time in that process is treated separately for limitation purposes.Settlement is part of Family Court procedure
The Family Courts Act provides for efforts to secure compromise or settlement at the pre-trial stage where possible and again after evidence has been completed. This makes settlement planning relevant even when a case is already in motion.Formal records still matter
The effect of terms can turn on their route and form. Properly signed and certified Legal Aid mediation agreements have statutory enforcement consequences, while court compromises, marriage or divorce registration, and documents intended for use abroad may require distinct steps.Questions, not prescriptions
