A hotel, resort, restaurant, tour business or destination project can bring together more than a single licence or contract. The legal questions may turn on the activity, site, ownership, investment structure, operating partners and customer model. Early alignment can help decision-makers test the route before acquisition, construction, launch or expansion commitments are made.

Classify the business model

Identify whether the proposal is an accommodation, food-service, tour, travel, online operator, development or mixed-use model, and map the approvals and operating duties that may follow.

Registration for one activity does not necessarily cover another activity, location or operating format.

Align the site and the permissions

Bring title, lease or development rights into the same planning sequence as construction conditions, operating permissions and any location-specific restrictions.

A site review should consider applicable Gazette designations, planning and other project requirements; it does not replace technical inspection or design advice.

Do hotels and restaurants need both registration and a licence in Bangladesh?
Generally, yes. The Bangladesh Hotels and Restaurants Act, 2014 provides that a hotel or restaurant may not operate without a registration certificate and a licence. The responsible authority and pathway vary by the type and category of operation. Safety, hygiene, relevant building approvals and other government permissions may be part of the assessment, depending on the facts and location.
Are online tour operators covered by Bangladesh's tour-operator regime?
Yes. The Bangladesh Tour Operator and Tour Guide (Registration and Operation) Act, 2021 includes online tour operators within its definition of tour operator. The Act prohibits tour-operator activity without a registration certificate and provides for a three-year certificate term, subject to renewal under the Act and applicable rules. Foreign persons or institutions require prior Government approval to conduct tour-operator or tour-guide activity.
Can tourism development face special restrictions because of its location?
Yes. The Government may declare a tourism protected area or special tourism zone by Gazette notification under the Bangladesh Tourism Reserved Area and Special Tourism Zone Act, 2010. Rules may impose restrictions. The effect should be assessed against the location, relevant Gazette notice, planning requirements and other applicable conditions before commitments are made.
