High Court Division · Special Original Jurisdiction
Md. Najmul Haque v Government of Bangladesh and others
Writ Petition 9780/2026 · Rule disposed of with direction · Decided 15 September 2026
The petitioner applied to the High Court Division under article 102 of the Constitution. On 30.08.2026 a Rule Nisi was issued calling on the respondents to show cause why the inaction of respondent No. 2 in disposing of the petitioner's application dated 24.06.2026 should not be declared to be without lawful authority and of no legal effect. The petitioner's case was that he had submitted a representation to respondent No. 2 on 24.06.2026 seeking rescheduling of his liabilities, but that the respondent was sitting idle without disposing of it, so he moved the Court and obtained the Rule. Having considered the facts and circumstances and the submissions of the petitioner's advocate, the Court took the view that justice would best be served, for now, by directing respondent No. 2 to dispose of the representation in accordance with law. The Rule Nisi was disposed of with that direction, and no order was made as to costs.
- Whether respondent No. 2 should be directed to dispose of the petitioner's pending representation for rescheduling of liabilities.
- Where a respondent has left a representation for rescheduling of liabilities undisposed of, justice may be served by directing the respondent to dispose of it in accordance with law.
- Respondent No. 2 was directed to dispose of the petitioner's representation dated 24.06.2026 in accordance with law.
- The Rule Nisi was disposed of, with no order as to costs.
we are of the view that the justice would be best served for now, if the respondent No. 2 is directed to dispose of the petitioner’s representation dated 24.06.2026 in accordance with law.
