The starting point

Choose the route before negotiating
the terms

Family disagreement calls for more than a preference for agreement. The relevant claim, any existing proceeding, the applicable personal law, the ability of each person to participate freely and the documents already in place can all affect the right next step. In Bangladesh, the route may involve pre-case Legal Aid mediation, settlement opportunities within Family Court proceedings or carefully managed private negotiations followed by appropriate formalities.

Define the legal and practical issues

Separate immediate arrangements from the questions that require formal resolution. Dissolution of marriage, restitution of conjugal rights, dower, maintenance, and a child’s guardianship or custody sit within the Family Court framework, subject to the applicable law.

Family settlement is not a catch-all route for inheritance, immigration, criminal allegations, protective relief or every financial issue arising from a relationship.

Test suitability and select the pathway

Consider whether a facilitated process is appropriate and whether a statutory pre-case Legal Aid mediation route may be relevant before court. Where proceedings are underway, settlement can also be considered within the Family Court process alongside a coherent position if agreement is not reached.

A procedural mediation route does not mean that joint discussion is suitable, safe or voluntary in every situation.

Understanding the Bangladesh framework

Bangladesh family settlement is shaped by both process and formality. The Family Courts Act, 2023 identifies specific family matters within the court’s jurisdiction and incorporates settlement efforts at defined stages of the proceedings. The Legal Aid Services framework, amended in 2026, may require an initial pre-case mediation application to the Legal Aid Office for scheduled disputes before an action is brought if mediation does not resolve the matter. The route and effect of any agreement depend on the claim, procedural stage, applicable law and the required formalities.

For matters covered by the statutory schedule, the Legal Aid framework provides for an initial pre-case mediation application. If mediation fails, the prescribed report is relevant to the subsequent court route; time in that process is treated separately for limitation purposes.

Does Bangladesh require family mediation before a Family Court case?
The Legal Aid Services Act, 2000, as amended in 2026, places the matters listed in section 5 of the Family Courts Act, 2023 in its schedule. For a scheduled dispute, the framework provides for an initial application to the Legal Aid Office for pre-case mediation before an action is brought in the competent court if mediation does not resolve the matter. The applicable route depends on the claim, procedural status and applicable law.
Can a mediated family settlement be enforced in Bangladesh?
A Legal Aid mediation agreement that is signed by the parties and mediator and certified by the Chief Legal Aid Officer has statutory finality and enforceability, and is treated as a court decree or final order for enforcement. In court-connected civil mediation, a written compromise may lead to a court order or decree. The requirements for a particular agreement depend on the route used and the subject matter.
Can mediation address children, maintenance or dower?
The Family Courts Act, 2023 includes maintenance, dower, and a child’s guardianship and custody within Family Court jurisdiction, alongside dissolution of marriage and restitution of conjugal rights. Whether a mediated process is suitable, and which formal steps may be required for an arrangement, depend on the circumstances and applicable legal framework.
