The starting point

Questions to frame at
the outset

Early project decisions can affect the way project documents, counterparties and public-sector decision points are considered. These questions are a starting point for defining a specific issue; they are not an approvals checklist or a determination of legal status.

01

What is the statutory and contractual route for the proposed petroleum activity?

Map the proposed activity, counterparties and key documents before committing to a structure. The petroleum-operation definition, any relevant petroleum agreement and the public-sector interface may need early consideration.

This page provides general information and does not determine a legal, regulatory or commercial outcome.

02

Which project documents need to be sequenced with regulatory or state-sector decision points?

Identify project-specific decision points and document dependencies, including how consent conditions and regulatory risk may be allocated in the relevant arrangements.

This page provides general information and does not determine a legal, regulatory or commercial outcome.

03

How should participation, terminal-use or asset-transfer arrangements allocate rights, obligations and consent risk?

Scope the asset, counterparties, governing documents and regulatory interface for the proposed project-specific transaction before relying on a document sequence.

This page provides general information and does not determine a legal, regulatory or commercial outcome.

Questions, not prescriptions

What may
matter.

These answers are general information. The applicable route depends on the facts, documents and current legal position.

What is a petroleum agreement in Bangladesh?
The Bangladesh Petroleum Act, 1974 defines a petroleum agreement as a production-sharing agreement or another agreement or contract relating to a petroleum operation. Section 4 is a statutory starting point: a person must not undertake or carry on a petroleum operation except under a petroleum agreement. Application depends on the proposed activity and applicable current instruments.
Which public institutions may be relevant to an oil-and-gas project?
EMRD, Petrobangla and BERC publish sector materials relevant to policy, state-sector, licensing or regulatory context. BIDA publishes investor-service materials. Any of these institutions may be relevant depending on the project; this is not an exhaustive approvals list or a statement that regulatory engagement is required.
Can this page tell me which project documents or consents are needed?
No. The page provides general information only. Project documents and regulatory interfaces need to be scoped together against the particular project facts, current law, rules, notices and applicable contractual arrangements before reliance is placed on any document or sequence.
